News from the last CIMG monthly meeting

It is with great pleasure that the CIMG Secretariat welcomed in CIMG Chairman and CIMG Advisors for 2008 at this montly meeting. The CIMG Chairman for 2008 is:

As well at this meeting, the CIMG Secretariat annouced an additional four Sustaining Sponsors. The additional Sustaining Sponsors are:

The CIMG Secretariat sincerely thanks these members as well as the other Sustaining Sponsors for there great support. It is with there support that the CIMG is able to produce the output that it does. These additional contributions will go towards the CIMG's ambitious work program for 2008. (A full list of the Sustaining Sponsors is listed on the CIMG website)

Prior to the member presentations Auslan provided a brief overview of some of the proposed activities that the CIMG will undertake in 2008. He noted that from the membership survey to key points arose. The first point is that members would like to see more engagement with Chinese Government and domestic industry. The second point being that the CIMG continue to focus its work on key focal areas such as Sustaible Mining, Mining Law and Taxation. In response to these needs and others from the CIMG membership Auslan mentioned that the CIMG will undertake three major projects in 2008. In addition to these major projects the CIMG Secretariat will undertake a number of other initiatives.

The first major project will be focus on sustainable mining and policy in China and its application in China. The project will undertake a research paper to assess the current situation, meaning and case studies of sustainable mining in China. This will be done alongside a number of industry roundtable discussions involving policy makers, academics, international mining companies and domestic mining companies. The CIMG will undertake the reseach with the China Academy of Sciences as well as with the support of a number of domestic industry associations. The first industry roundtable will take place at the 2008 China Nonferrous Metals Mining Forum in April. The CIMG urges members to be involved in this project whose output will be used to lobby policy makers in regards to the implementation of Chinna's Mining Law.

The second major project will focus on taxation. Many members have raised comments regarding the China's taxation regime for resources. Many members will remember that in 2003 and 2005, the CIMG undertook with MOLAR and SAT a series of 'Mining Tax Workshops'. The 2008 taxation project will take on a similar note and build on the work already completed in 2003 and 2005. It is hoped that this project will bring about a better understanding of the impact of China's taxation regime for resources sector and suggestions for its future development.

The third major project will focus on China's mining law and build upon the work in the CIMG's White Paper 2007. In a recent meeting with MOLAR officials noted that the 2007 Paper had been read and contained a number of good suggestions. MOLAR have agreed to a number of roundtables in 2008 to further explore these suggestions as well as other issues facing China's mining sector. The output generated from these roundtables will form the backbone of the CIMG's White Paper 2008.

Auslan also mentioned the following additional activities in 2008:

  • Coal Discussion Group: will continue its activities to cater for members intersted in Coal
  • Industry Networking: there will be a number of dinners to provide networking opportunites to CIMG members with Chinese mining associations
  • Missions: The CIMG will undertake missions to provincial China. The first being to Inner Mongolia in late March
  • Golf Day: The CIMG will hold another great day on the course on May 16

Following this presentations were given on China's new Employment Contract Law. The law took effect on January 1 2008, and the changes are significant. The new labor contract law, enacted by the Standing Committee of the National People's Congress installs a sweeping new labor law that strengthens protections for workers across its booming economy. Luka Lu from Capital Associates spoke about the new contracual arrangements and mass lay-offs made in the new law. Ben Zu spoke on the the history of thenew law. There was a lively discussion afterwards on some of the vagaries of the law by the members which highlights the need for additional dicussions with government on the implementing regulations. In closing the meeting Auslan wished the members a great start to the year of the Rat.

2008 China Nonferrous Metals Mining Forum
Tuesday April 15 - Saturday April 19

2008 China Nonferrous Metals Mining Forum will be held in Nanning, Guangxi Province between 15th -19th April 2008. This forum will focus on South Western China as an important production and reservation base for the nation's nonferrous metals and gold mineral resources, which accounted for more than half of the total reserves and became the primary provider of China's nonferrous metals raw materials. The forum in the past has been well attended with many seminar sessions on mining development and other potential projects.
The CIMG and the CNIA will be holding a roundtable on April 16th. The aim of the roundtable is to bring together domestic and foreign companies to discuss the challenges facing the implementation of sustainable mining in China. We urge members and other companies to join in this discussion.

The CIMG is now contributing to a number of publications. The Secretariat is seeking content related to Environment, Community, Safety and Technology. Articles should be case studies, in Chinese and 2 pages long. This is a unique chance to share information and promote the international mining community in China. MLR Beijing issued 2 new regulations. The CIMG was recently informed that MLR Beijing issued 2 new regulations that will come into affect on the Jan 1 2007:

Notice of Further Regulating Exploration Licenses and Mining Licenses Granting/Transfer Process Management

Notice of the People's Government of Yunnan Province on new four laws including Management Rules of Yunnan Province for Rights of Exploitation and Mining. Laws in Yunnan were released that focus on the Rights of Exploitation and Mining, Interim Procedures of Yunnan Province for Levying and Management of Fees for Compensated Use of Mineral Resources, Interim Procedures of Yunnan Province for Management of Mineral Property Transaction, and the Interim Procedures of Yunnan Province for Management of Deposit for Security for Rehabilitation and Governing of Mine Geologic Environment.
